Today the High Court of Uganda delivered judgement in Human Rights Awareness and Promotion Forum (HRAPF) Vs Attorney General and Commissioner General of Prisons, High Court Miscellaneous Cause No.81 of 2020. The judgement was passed in favor of 19 LGBT youth, on whose behalf the suit was instituted. HRAPF filed the suit, following denial of access to the 19, in their capacity as legal counsel, by the Commissioner General of Prisons, citing the need to curb the spread of COVID-19. In his judgement, Justice Michael Elubu held that the denial of the 19 access to their lawyers tantamounted to a violation of their right to fair hearing, which is non-derogable, even in the face of the novel COVID-19 pandemic. He awarded each of them compensation to a tune of Ugx.5,000,000/= (Five Million Uganda Shillings Only). We applaud the decision of the High Court, which vindicates our clients' rights.
